JUDGMENT

1. The appellant pleaded guilty to a charge of burglary and was sentenced to 9 months imprisonment. On appeal I reduced the sentence to 4 months imprisonment. He has a record of convictions on 37 occasions, but 33 of them are for either smoking or possessing opium. A further 2 are for larcenies in 1967, and the remaining 2 are for larcenies in 1969. Judging by the sentences imposed all 4 larcenies were petty offences.
2. On the occasion of the present offence he entered unattended premises by an open main doyor and stole cash $400 and a wrist-watch valued at $150. Nothing was recovered. I was prepared to believe his plea that it was a case of giving way to temptation, and having regard to this, his age (54 years), and his plea of guilty, reduced the sentence as indicated above.
