CACC000339/1971

IN THE SUPREME COURT OF HONG KONG

(APPELLATE JURISDICTION)

CRIMINAL APPEAL NO. 339 OF 1971

-----------------

BETWEEN
TONG YEE TAKAppellant
and
THE QUEENRespondent

-----------------

Coram: Huggins, J.

Date of Judgment: 14th July, 1971.

-----------------

JUDGMENT

-----------------

1. The Appellant was sentenced to nine months' imprisonment for unlawful possession of a dangerous drug. He was stopped in the street by a police officer, who found on him one packet of dangerous drugs containing 0.1 gramme of salts of esters of morphine. The Appellant appeals against his sentence.

2. He asserts before me that he understands this sentence is longer than is normally imposed for offences of this kind, but clearly that is not correct and his own record shows that he himself has been to prison for nine months on three separate occasions. He has, in fact, been before the court on eleven previous occasions for offences under the Dangerous Drugs Ordinance, the sentences imposed varying from a fine of $200 or five weeks' imprisonment to two years' imprisonment. The first offence was in December 1957 and he tells me that he has received treatment in the Tai Lam Chung Drug Addiction Treatment Centre.

3. In these circumstances it seems to me that the sentence was a proper one and the appeal is dismissed.

14th July, 1971.
