J U D G M E N T

1. This was an appeal against a total sentence of 12 months imposed for offences of theft and breach of condition of stay which attracted sentences of three months each, ordered to be run concurrently; and using a Hong Kong Identity Card relating to another person, for which a sentence of 12 months was passed, which was ordered to run consecutively to the other sentences.

2. These were perfectly proper sentences and fell within the normal range of sentences for offences of this nature. However, as an act of mercy, because of his family circumstances, I felt that I could reduce the sentence of 12 months on the charge of using an identity card relating to another person to nine months. The total sentence therefore became 12 months.
