IN THE HIGH COURT OF THE

HONG KONG SPECIAL ADMINISTRATIVE REGION

COURT OF FIRST INSTANCE

MAGISTRACY CRIMINAL APPEAL NO. 10 OF 1998

____________

BETWEEN
HKSAR
AND
WONG TZE FAIAppellant

____________

Coram: The Honourable Madam Justice Beeson in Court

Date of Hearing: 17 February 1998

Date of Delivery of Judgment: 17 February 1998

_______________

1. In this case the Appellant appealed against a sentence of 3 months' imprisonment imposed on him by a Magistrate for assaulting a police officer acting in the execution of his duty.

2. Today the Appellant advised the court that he wished to abandon this appeal against sentence. On being asked whether he had seen the Magistrate's reasons for sentence, he told the court that he had not and accordingly I read out the reasons to him.

3. The Appellant then confirmed that he wished to abandon his appeal. I am satisfied from my view of the papers and the Magistrate's reasons that the sentence was entirely appropriate.

4. The appeal against sentence is dismissed.

Representation:

Lily Ho, S.G.C., for DPP.

Wong Tze Fai, Appellant, in person.
