J U D G M E N T

1. The appeal against conviction is dismissed. In my view, there was sufficient evidence for the Magistrate to have found the Appellant guilty and I find there is nothing in ground 2, which was the allegation that there was a material irregularity in the trial because counsel was stopped from cross-examining PW1 on the cost of repair to PW1's vehicle. That was a matter which was not relevant to the driving charge and so the Magistrate was quite entitled to stop counsel from pursuing that particular line of cross-examination.
