J U D G M E N T

1. This petition is brought by Ecnet (Hong Kong) Limited. The debt is in the sum of HK$123,813.93 plus interest and this arose out of a loan agreement dated 8 October 1999 entered into between the debtor, Mr Wong Sik Kwan, and the petitioner.

2. The statutory demand was served on the debtor personally on 12 July 2001. The petition herein was filed on 21 August 2001 and served on the debtor personally on 22 August 2001. When the petition came before me on 10 December 2001, the debtor asked for an adjournment to give him an opportunity to raise money to repay the petitioner. I adjourned the petition to today on the basis of the debtor's indication that he would need one month for this purpose. No payment has since been made by the debtor, as confirmed in the affirmation of continuing indebtedness filed by the petitioner on 5 January 2002. I was told by Ms Chong who appeared for the petitioner that the debtor telephoned her this morning and informed her that he would not attend court.

3. In the circumstances, I make a bankruptcy order with costs to the petitioner, including the costs reserved by the master on 6 December 2001.
