D E C I S I O N

_________________

Background

1.  This is the application by the applicant to vary the costs order nisi made on 6 September 2017 against her (“Costs Order Nisi”).

2.  The Costs Order Nisi was made after trial on the interlocutory application filed by the 2nd and 3rd respondents (“R2” and “R3” and collectively referred to as “Rs” in this judgment) seeking to set aside the possession order made on 9 March 2016 and the writ of possession issued on 1 April 2016.  The agreed issues to be tried are:

“9. 在2017年2月7日的審前覆核聆訊上,雙方同意本案的爭議點為 :

一) 該三房單位究竟是132A號還是132B號?

二) 葉氏父女是否強行霸佔該三房單位,如是,葉氏父女無權就該收樓令提出反對;及

三) 葉先生曾否出錢出力修復132號及興建該兩石屋,以換取該三房單位的權益,如是,程女士無權以該收樓令驅趕他們。”

3.  In the judgment handed down on 6 September 2017 (“Judgment”), it is ordered that:

“35. 本席頒令,本審裁處在2016年3月9日頒下的該收樓令,及在2016年4月1日發出的收樓令狀,均予以撤銷。

36.  在訟費應視乎訴訟結果而定的大前題下,本席頒令申請人須付第二及第三答辯人本申請的訟費,包括大律師證書,如雙方未能就訟費數額議定,則由法庭依區域法院基準作評定。這是暫准訟費命令,除非任何一方以傳票申請,否則本暫准訟費命令在本判決書發下後14天成為絕對命令。”

4.  By Summons dated 20 September 2017, the applicant seeks to vary the Costs Order Nisi to one of no order as to costs.

Applicant’s Case

5.  Mr Yiu for the applicant relied on 2 grounds in support of the variation application, namely:

a.   the claim by the R3 that he had beneficial interest in the Suit Premises is outside the jurisdiction of this Tribunal; and

b.   the conduct of the proceedings by the Rs.

6.  On the jurisdiction point, it is the submission of the applicant that since the Rs’ case was dependent on their beneficial interest in the Suit Premises upon which the Tribunal has no jurisdiction, the Rs ought to have applied to transfer the proceedings to the District Court or Court of First Instance under section 8A of the Lands Tribunal Ordinance.  Since the Rs had conducted the litigation on an issue that falls outside the jurisdiction of this Tribunal, they should not be awarded with costs.  Furthermore, as the Tribunal has no jurisdiction to adjudge on the issue of beneficial interest in the Suit Premises, even though the Rs have been successful in the proceedings, through the raising of the issue of beneficial interest, it cannot be characterized as a successful allegation (due to no finding) but such an issue caused a significant increase in the length and costs of the proceedings, in which the Rs should not be awarded with costs.

7.  It is also submitted that by raising the issue on beneficial interest in the Suit Premises in the conduct of these proceedings, the Rs had adduced a significant amount of evidence via oral examination-in-chief, with the evidence of the Rs taking up the original 4 days fixed for trial and leading to the trial being prolonged to 9 days.  Such orally adduced evidence can in effect be characterized as amounting to a supplemental affirmation without leave and this is against the underlying objectives and should not have been awarded with costs.  The Rs had induced the applicant spending costs and time to deal with such new issues and 60% of the costs of the proceedings should be awarded to the applicant.

Rs’ Reply

8.  Ms Chan for the Rs submitted that the issue on the beneficial interest is relevant as to why the Rs were occupying the Suit Premises and not that the Rs suddenly moved into the Suit Premises without consent of the applicant as alleged.  The Rs had never asked for any declaratory relief in respect of their beneficial interest.  In any event, this is an agreed issue to be tried and it is not an issue raised by the Rs.  The Tribunal was of the view that it is not necessary to rule on this issue, it does not mean that the court had ruled against the Rs or that the Rs had failed on this issue.

9.  As for the conduct of the proceedings, it is submitted that 2 hours of examination-in-chief for each witness is not excessive and the issue on beneficial interest is not a new issue which should take the applicant by surprise.  The Rs had not significantly increased the length of trial and the applicant should also be blamed for the need to re-call one of her witness which also lengthened the trial.  Since both sides had taken up more or less the same amount of the time during the entire 9-day trial, the extension of trial cannot be said to be solely caused by the Rs’ examination-in-chief. Since the Rs are the successful party in this case, there is no ground to depart from the normal rule of “costs should follow the event”.

Legal Principles

10.  Section 12(1) and (7) of the Lands Tribunal Ordinance (“LTO”) provides that:

“(1) The costs of and incidental to all proceedings in the Tribunal are in the discretion of the Tribunal, and the Tribunal has full power to determine by whom and to what extent the costs are to be paid.

(7)   Notwithstanding subsection (1) and section 12C but subject to subsection (5) and any rules made by the Chief Justice under section 10(3), Order 62 of the Rules of the High Court applies, with the necessary modifications, to the award, taxation and recovery of costs in the Tribunal.”

11.  Order 62, rule 3(2) of the Rules of the High Court states the general proposition that costs should follow the event, unless in the circumstances of the case some other order should be made as to the whole or any part of the costs.

12.  Order 62, rule 5 reads:

“5(1) The court in exercising its discretion as to costs shall, to such extent, if any, as may be appropriate in the circumstances, take into account -

(aa) the underlying objectives set out in Order 1A, rule 1;

(a) any such offer of contribution as is mentioned in Order 16, rule 10, which is brought to its attention in pursuance of a reserved right to do so;

(b) any payment of money into court and the amount of such payment;

(c) any written offer made under Order 33, rule 4A(2);

(d) any written offer which is expressed to be ‘without prejudice save as to costs’ and which relates to any issue in the proceedings, but the court may not take the offer into account if, at the time it is made, the party making it could have protected his position as to costs by means of a sanctioned payment or a sanctioned offer under Order 22;

(e) the conduct of all the parties;

(f) whether a party has succeeded on part of his case, even if he has not been wholly successful; and

(g) any admissible offer to settle made by a party, which is drawn to the Court’s attention.

(2) For the purpose of paragraph (1)(e), the conduct of the parties includes -

(a) whether it was reasonable for a party to raise, pursue or contest a particular allegation or issue;

(b) the manner in which a party has pursued or defended his case or a particular allegation or issue;

(c) whether a claimant who has succeeded in his claim, in whole or in part, exaggerated his claim; and

(d) conduct before, as well as during, the proceedings.”

Discussion

13.  I do not agree with the applicant that the issue on beneficial interest is not within the jurisdiction of this court and should not be raised in the first place.  As I have indicated at the hearing, there must be a distinction between the jurisdiction to grant a declaratory relief concerning the R3’s beneficial interest in the Suit Premises and the jurisdiction to hear evidence and rule on the factual argument as to under what circumstances the R3 started to occupy the Suit Premises.  This Tribunal do not have the jurisdiction to grant a declaratory relief over any beneficial interest in any property but there is nothing to prevent this Tribunal to hear and rule on evidence in support of the Rs’ case.  I do not agree with the applicant that the Rs should have never raised this issue in this case or that the Rs should have asked for this case to be transferred to some other court. I fail to see how can the application by the Rs to set aside an order made by this Tribunal be transferred and to be disposed of by some other court.

14.  In the Judgment (at §34), it is found that this Tribunal should not make any findings in the issue of beneficial interest of the R3 since this Tribunal had no jurisdiction to grant any declaration over the beneficial interest of the R3 in the Suit Premises and most importantly, any ruling in this case will affect the right of the R3 to take the matter further in some other court due to the doctrine of res judicata.  This is the reason why the jurisdiction point is mentioned and not, as submitted by the applicant, that this Tribunal declined to deal with the issue due to a lack of jurisdiction or the Rs had failed in this issue.

15.  Given the findings on the jurisdiction point above, I do not agree that the Rs had caused a significant increase in the length and costs of the proceedings by putting before this Tribunal evidence relating to the R3’s beneficiary interest in the Suit Premises.  By the same token, the argument that this reflected on the conduct of the proceedings by the Rs cannot stand since evidence concerning the beneficial interest of the R3 in the Suit Premises is apparently relevant in this case.

16.  Having said so, this Tribunal cannot ignore the fact that most of the details about the issue on beneficial interest only come out in the examination-in-chief of the Rs when such details should have been included in their witness statements.  Keith J. said in Ng Kam Chun v Chan Wai Hing and Others [1994] 2 HKLR 89 at 90:-

“The time has now arrived when it is necessary for someone to spell out to those who are responsible for drafting witness statements that they must get their act together. The witness statement should contain the whole of the witness' evidence in the detail in which the witness would have given it if his evidence had been elicited by oral questions at the trial. Anything less than that prevents the statements from serving the purposes which they are intended to achieve - saving time, eliminating any element of surprise in the witnesses' evidence, enabling the parties to know the full strength of the case they have to meet, and enabling counsel to prepare a crisp and effective cross-examination.”

17.  There is no explanation as to why such details have not been stated in the witness statements.  Had such details been disclosed in the witness statements, much time spent in the examination-in-chief of the Rs could be saved.  I agree with the applicant that such a fact should be reflected in the Costs Order Nisi but not to the extent of 60% as suggested by Mr Yiu.  I think a deduction of 10% of the total costs to be awarded to the Rs should be a more reasonable account for the poor preparation of the witness statements by the Rs.

Conclusion

18.  The Rs are the successful party in this case and should be entitled to have the costs of these proceedings, save and except for the time spent in examination-in-chief of the Rs due to the poorly prepared witness statements.  Under such circumstances, the Cost Order Nisi should be varied to the applicant do pay the Rs 90% of their costs in these proceedings, with certificate for counsel, to be taxed if not agreed on District Court scale.

19.  As for costs of this variation application, since both parties are partially successful in their argument, I think the proper order should be no order as to costs.  This is a costs order nisi.  Unless any of the parties apply by summons to vary it, the costs order nisi shall be made absolute upon expiry of 14 days.

背景事實

1.  在羅湖路沙嶺132號 (「132號」) 的範圍內,建有兩間平排相連的石屋,一間為兩房單位 (「該兩房單位」),而另一間為三房單位 (「該三房單位」)。證物A1為雙方同意的就132號及附近的地形,從一條鄉村通道 (「該鄉村通道」) 可達132號的入口,那處設有一個鐵閘 (「該132閘」) (B/32相片所示),入閘後第一間石屋為該兩房單位,之後為該三房單位 (證物A4相片為兩間石屋的前方),三房單位出門的左方為一條私家路 (「該私家路」) (證物A3相片所示),可通往沙嶺131號及從位於131號的門閘出入 (「該131閘」)。132號所在位置,在2016年1月4日之前屬邊境禁區,在內作探訪、居住或工作,也須向邊界警區邊境禁區許可證辦事處 (「禁區房」) 申請禁區紙,唯此規定隨著禁區在2016年1月4日開放後取消了。

2.  本案的申請人 (「程女士」) 及家人同住沙嶺133號,她在2016年2月23日存檔了本案的申請,指稱與案中第一答辯人 (「曾女士」) 之間為業主與租客的關係,雙方在2014年11月28日簽署了書面租約 (B/164) (「涉案租約」),租用單位為新界上水羅湖路沙嶺132號B房 (「涉案單位」),租期由2014年11月28日至2016年11月27日,每月租金500元。 程女士在申請通知書 (B/1) (「表格22」) 中以曾女士從2015年5月28日起開始欠租為理由申請收樓令。

3.  程女士在送達文件確認書中指稱,在2016年2月23至25日連續3天,將表格22及實際管有或居住者通知書在涉案單位門外張貼,及將表格22以平郵寄送至沙嶺村居民信箱105號。

4.  由於曾女士未有在本案中存檔任何反對通知書,本席在2016年3月9日頒下無抗辯得直令,除了頒下收樓令 (「該收樓令」) 及濟助外,本席亦頒令曾女士須清繳由2015年5月28日起至交回處所空置管有權為止的租金/中間收益以及本申請的訟費。

5.  程女士在2016年3月24日向審裁處申請收樓令狀,相關的收樓令狀在2016年4月1日發出 (「該收樓令狀」)。執達吏在2016年4月18日在程女士的帶領及指示下,將「佔用人遷出通知書」 (「佔用人通知書」) 張貼在該三房單位外。又在2016年5月4日再將佔用人通知書派送到該三房單位,由第二答辯人 (「葉小姐」) 收取。

6.  葉小姐與第三答辯人 (「葉先生」) 為父女關係,他們在2016年5月7日存檔了非正審申請書 (B/3-6) ,要求加入本案為答辯人,申請暫緩執行及撤銷該收樓令。葉氏父女在申請中指稱,該三房單位的門牌號碼實為132A,而並非132B,他們一家自2008年起居住在該三房單位內,是在葉先生與程女士丈夫袁惠新先生 (「袁先生」) 口頭協議下,替袁先生在132號內進行翻新及興建兩間石屋,以換取該三房單位的權益,在石屋建成後,葉先生與袁先生在2008年10月1日簽立了一份名為買賣合約 (B/35) (「該買賣合約」) 的文件;他們不認識曾女士,也從未與程女士或袁先生達成任何租約或特許使用的協議。

7.  程女士就葉氏父女的申請提出反對,指稱是袁先生為了照顧葉先生及其家人,給予他們特許使用權,住進門牌為132A的該兩房單位,葉先生從未參與132號的翻新工程,袁先生也從未與葉先生簽立過該買賣合約。程女士將該三房單位的三個房間,分別出租予曾女士、曹均容女士 (「曹女士」) 及李建平先生 (「李先生」) (B/167-168及170-171),但曾女士在2015年5月開始沒有繳付租金,亦不經常回到該三房單位,葉氏一家開始在該三房單位內出現,最終更全家搬到該三房單位內居住,程女士迫於無奈向審裁處提出了本案的申請。

8.  審裁處在2016年7月18日批准葉氏父女加入本案成為答辯人,亦頒令須就葉氏父女的申請進行審訊。

9.  在2017年2月7日的審前覆核聆訊上,雙方同意本案的爭議點為:

一) 該三房單位究竟是132A號還是132B號?

二) 葉氏父女是否強行霸佔該三房單位,如是,葉氏父女無權就該收樓令提出反對;及

三) 葉先生曾否出錢出力修復132號及興建該兩石屋,以換取該三房單位的權益,如是,程女士無權以該收樓令驅趕他們。

葉氏父女的案情

10.  除了葉氏父女兩人作供外,他們亦傳召了街坊楊女士 (「楊女士」) 在本案中作供。

葉小姐證供

11.  葉小姐在證供中指稱,她在2008年由內地來港,在親友家中住了一個月後,在2008年11月遷入該三房單位至今,從未在該兩房單位內居住,也不認識曾女士、曹女士及李先生,一直以來該兩房單位也無人居住,只是程女士用作儲物,偶爾也見程女士的子女入內玩耍或做功課;除此以外,從未見其他人在該兩房單位出入或居住。 一直以來她和家人也利用該私家路出入,但至2016年農曆年初十左右,程女士及袁先生以鐵絲網圍封了該三房單位至該私家路的出入口 (B/115相片),自此她及家人只能使用該132閘作出入之用。該三房單位曾使用35號及132A號的門牌號碼,35號是在申請電錶時使用,而132A則是在申請水錶時使用的,該兩房單位沒有任何水錶及電錶。

12.  她在2016年5月4日收到執達吏派送的佔用人通知書 (B/14) 後,翻看三房單位的閉路電視,發現以下情況:

一) 2016年2月23日,程女士在該三房單位門前張貼了兩份文件,葉氏父女回家後將文件撕下,其中一封是袁先生給予禁區房,日期為2016年1月6日的信件 (B/178) ,表示以往讓葉先生及其子女暫時居住在沙嶺村35號,但決定由即日開始收回單位自用,特此通知禁區房,而另一封信件也是類似文件,但葉小姐說已找不到這文件;

二) 2016年2月27日下午4時14分,程女士及其家庭佣工以白色帆布遮蓋該三房單位外的閉路電視鏡頭 (B/16);

三) 2016年3月16日上午8時47分,程女士在該三房單位的外牆上,噴上132B的門牌號碼 (B/17);

四) 2016年4月18日上午11時19分,程女士帶同兩位執達主任到該三房單位門口張貼文件,之後在上午11時29分,程女士的佣工將執達主任張貼的文件撕去 (B/18);

五) 2016年4月25日上午9時30分,程女士再以筆在該三房單位外牆寫上132B的字眼,這是因為葉先生早前將之前由程女士噴上的B字刪去了 (B/39 相片);

六) 2016年5月4日中午12時14分,程女士將閉路電視的鏡頭調較至只拍到藍色的帆布 (B/20);

七) 從2016年2月開始,程女士以帆布遮蓋該三房單位的所有門窗 (B/113-114及117)。

葉先生證供

13.  他在1999年在工作上認識了袁先生,雙方關係友好,在2007年終時,葉先生向袁先生提及子女將申請來港,要為居住地方張羅,建議替袁先生翻新132號,最終他與袁先生達成口頭協議,由葉先生將132號內的豬屋、鷄屋及雜物屋翻新及改造,建造成兩間獨立式的石屋,袁先生承諾會將其中一間石屋給予葉先生,袁先生更建議完成改建後,雙方『簽番幾個字,第日細路仔大咗唔好抝頸」,故而寫下了該買賣合約,但不涉及任何錢銀交易。葉先生及袁先生也各有安排購買材料,工程則由葉先生及其聘請的工人依據袁先生指示的尺碼進行,兩間石屋的內部間隔,葉先生只負責該三房單位的設計。在改建132號後,葉先生也興建了該私家路。

14.  在完成改建後,雙方簽署了該買賣合約,葉先生以該買賣合約及電費單申請禁區紙,因在文件上顯示存在錢銀轇轕,申請不獲批准。之後袁先生另簽署了一份信件 (B/97) ,以證明『本人有一間空置的寮屋,有見及此,現本人毫無條件贈讓至葉瑞生一家居住』,但仍不獲批出禁區紙。最終在一位袁偉忠先生(「袁師傅」)介紹下,找到鄉事委員會及區議員協助,才成功獲批。葉先生與葉小姐在2008年11月11日遷入該三房單位居住至今,其太太及兒子則在2010年時入住。

15.  葉先生指稱,他在2008年12日已開立了電錶供電至該三房單位 (B/36),電錶註明是35號,這是當時協助他申請電錶的袁師傅在看過附近門牌是33及34號後,建議採用35號。而由於該兩房單位沒有開立電錶,葉先生同意讓袁先生將電由其電錶接駁至該兩房單位。而水錶的申請也是由袁師傅處理,在地圖看到132號,故此使用132A號作為登記地址,因申請需時,水錶只在2011年4月才成功登記,之前由133號屋駁水至該三房單位。

16.  至2016年1月4日禁區開放後,袁先生反悔並在1月5日與程女士到該三房單位,要求葉先生簽署租約,葉先生拒絕,袁先生即表示要收回該三房單位。之後更將該131閘換鎖,以致葉先生一家不能使用該私家路返回該三房單位,而必須使用該132閘進入。

楊女士證供

17.  楊女士是沙嶺村原居民,她家族的祖墳位於131號屋附近,在2008年時到祖墳拜祭,看到工人在翻新132號的舊屋,也看到葉先生在場指示工人工作,132號翻新完成後,也舖了該私家路。在2008年7月再到祖墳時,認識了葉先生的太太 (「葉太太」),至2009年時再遇到葉太太,得悉她一家住在該三房單位,雙方開始熟絡,並經常到該三房單位,葉太太也曾向她提及葉先生與袁先生的協議。在2016年3月以前從未見到任何門牌碼號碼在132號內兩間石屋的牆上。

18.  她在2013年時認識了曾女士,曾女士曾是她的租客。在2014年曾女士沒再租用她的單位後,曾在羅湖關卡碰見曾女士,當問

及曾女士搬到那𥚃居住時,曾女士表示本打算租住程女士的該兩房單位,雙方簽了租約打過厘印,但因程女士證件不足,未能成功辦理禁區紙,故此最終沒有租住過。楊女士解釋,程女士不能替曾女士完成禁區紙的申請,因為程女士所住的133號屋的寮屋證屬其老爺名下,而其老爺已去世多年,故此不能成功辦理。

申請人案情

19.  申請人程女士、其丈夫袁先生也在本審訊中作供,亦傳召了禁區房的吳警署警長 (「吳警長」) 作供。

程女士證供

20.  程女士作供指稱,132號內的翻新及重建工程,全由她及袁先生在2008年9月至2008年12月斥資購買材料及聘請工人進行,葉先生從沒參與,並提交了購買物料單據 (B/58-91) 作佐證。當時將該兩房單位稱為132A,打算作為她及袁先生的居所,而該三房單位稱為132B,則作為三名子女的居所。她及袁先生為了照顧葉先生一家,將132A即該兩房單位無條件讓他居住,亦協助葉先生取得禁區紙。

21.  該私家路是2000年時,程女士及家人維修133號屋時興建的,之後裝上該131閘及上鎖,2000年前全靠該鄉村通道出入。一直以來也沒向葉先生提供該131閘的鎖匙,但因是禁區範圍內,故此一向也沒有上鎖,故而葉先生一家也可使用。

22.  程女士又指,曾女士是由葉先生在2014年10月介紹來租用單位的,透過曾女士她也認識了曹女士及李先生。在2014年11月28日分別與他們三人簽立了租約,將該三房單位內的三個房間分別租予他們三人 (B/164-171) ,為期兩年, 在此之前該三房單位只作儲物之用,與三位租客立約時,已明言不會替他們辦理禁區紙。三份租約上所顯示租用單位也是132號,她本人也不知道那位租客使用那個房間。

23.  程女士承認,她在土地審裁處入禀時,職員表示因為132號包括兩個單位,必須在申請書上清晰標示,故建議以A標示該兩房單位,B標示該三房單位,故而程女士入稟時在與曾女士已簽署的租約上,加上B字。曾女士在2015年5月開始欠租,並且不經常返回單位,另外曹女士及李先生也是差不多同一時間沒有繳付租金,至2015年4月葉先生一家開始在該三房單位出現,將傢俬搬出搬入,最後更整家搬入該三房單位居住,以致租客也未能返回該三房單位,同時也繼續佔用著該兩房單位,故此她在2016年1月5日要求葉先生簽署新租約,只收一元租金,但葉先生表示如要收取租金,他不再居住並要求給予一個月時間遷出,至1月中葉氏一家遷出了該兩房單位,但仍佔用該三房單位。2月7日程女士將該131閘鎖上,葉先生未能返回單位,報警後程女士讓葉先生使用該132閘進出,但之後葉先生一直未有遷出,她在2016年2月23日提出了本案的申請。

24.  程女士亦解釋,她在2016年3月16日及4月25日在兩個單位的外牆中間位置寫上132A及132B的標示,是因為方便執達吏辨識,在此之前兩個單位的牆上也沒有任何標記。

袁先生證供

25.  袁先生否認曾與葉先生達成任何口頭或簽立任何書面協議,並指葉先生所提交的該買賣合約屬偽造,已報警查辦,亦否認葉先生曾參與132號的翻新工程。解釋只是出於好意,讓葉先生及其家人在無代價的情況下,在該兩房單位居住,又為他們申請禁區紙,申請文件全由葉先生準備讓他簽名,他在文件上加入手寫字,註明是讓葉先生一家暫住,並寫下年期,由於35號只是電錶號碼,故此也加入了詳細地址 (B/97);而第一次申請時他也曾陪同葉先生到禁區房辦理,在之後的續期申請中,他只簽了由葉先生準備的文件,讓他交予禁區房。他在2016年1月6日已去信知會禁區房,決定收回132A單位 (B/97A)。

吳警長證供

26.  吳警長作供確認,禁區在開放前,禁區房會發出探訪、工作及居住三種不同的禁區紙,當中只有居民禁區紙容許持證者在禁區內居住;其部門只保留成功申請的資料,而未有保留不成功申請的個案。

27.  居民在申請禁區紙時,須出示最少兩樣的住址證明,如租住、居住或業權證明,另加水電費單,如住址證明的登記人並非禁區紙申請人,則須同時提交登記人的同意信或授權讓申請人居住的書面證明或關係證明書 (B/233);如屬租約限定的禁區紙申請,業主在第一次申請時必須陪同出席辦理,雖然業主出示其名下的寮屋牌便可視作成功證明業權,但寮屋是不可以出租的,必須是登記人自住,故此不會接受依賴寮屋租約的申請,十年內也沒有以寮屋租約來申請禁區紙的個案;而禁區內除了寮屋,就只有擁有業權的屋。禁區房也會接受如本案中俗稱贈住信/暫住信 (B/223及231) 的文件作禁區紙的申請,但如業主未能證明擁有有效的業權也不會獲批出禁區紙,祖堂的支持信件也徒然。而非居民禁區紙 (又稱探訪紙),一般發出的只為4天證,在完成探望後離開禁區須交回探訪紙,如被發現過期逗留,會被拘捕;而如果持有探訪紙卻並非作探訪,則擔保人可被視作違反條款。但如探訪者與擔保人存在親屬關係,如有關係證明,可批准長探(即超過4天的探訪證)及容許持證人居住,如只屬朋友關係,一般只給予1天探訪證,但通常申請人會表示探訪日期不確,故此禁區房會發出4天證作彈性處理。唯在發出探訪證後,持證者在禁區內從事什麼活動或是否居住,禁區房也無從知曉。

28.  吳警長翻查了曾女士、曹女士及李先生的申請禁區紙紀錄,發現曾向他們三人發出過居民及非居民禁區紙,但從未發出過工作禁區紙:

一)   就曾女士而言,曾發出以下的禁區紙:

-   2012年11月26日至2013年11月26日為期一年的居民禁區紙;

-   2013年2月26日至2013年5月24日為期3個月的居民禁區紙;

-   2013年5月15日至2014年5月14日為期一年的居民禁區紙;

-   除此以外,在2014年10月3日至2015年1月10日期間,曾向曾女士發出6次非居民禁區紙 (即探訪紙),每次為期4天,之後沒再申請,在2014年11月28日至2015年1月10日期間,只有2次發出非居民禁區紙的紀錄;

-   無論是居民或非居民禁區紙,所涉申請的地址也非132號或沙嶺村35號,也沒有涉及程女士或袁先生作為擔保人的申請。

二)   就曹女士而言,曾發出以下的禁區紙:

-   2012年4月23日至2013年4月22日為期一年的居民禁區紙;

-   2013年4月22日至2014年4月21日為期一年的居民禁區紙;

-   2014年4月17日至2014年4月18日為期兩天的居民禁區紙 (因被發現是水貨客,故此收回發出的禁區紙);

-   除此以外,在2014年5月10日至2015年12月27日期間,曾向曹女士發出45次非居民禁區紙,每次為期4天,在2015年12月27日後沒有再申請,當中由2014年11月28日至2015年12月27日期間共25次;

-   無論是居民或非居民禁區紙,所涉申請的地址也非132號或沙嶺村35號;也沒有涉及程女士或袁先生作為擔保人的申請。

三)   就李先生而言,曾發出以下的禁區紙:

-   2013年5月7日至2013年8月6日為期3個月的居民禁區紙;

-   2013年8月5日至2014年2月4日為期6個月的居民禁區紙;

-   除此以外,在2014年4月26日至2015年12月22日期間,曾向李先生發出44次非居民禁區紙 (即探訪紙),每次為期4天,當中由2014年11月28日至2015年12月27日期間共26次;

-   無論是居民或非居民禁區紙,所涉申請的地址也非132號或沙嶺村35號;也沒有涉及程女士或袁先生作為擔保人的申請。

涉案單位是否該三房單位

29.  在聽取了雙方的證供,及在平衡雙方證供可能性的標準下,本席認為答辯人一方的證供較為可信。

30.  本席認為申請人一方的證供,存在以下的固有不可能性,令人難以置信:

一) 如該三房單位內的三個房間,是分別出租予曾女士、曹女士及李先生三人,為何在三人也沒再繳付租金的情況下,只向曾女士一人申請收樓?

二) 程女士表示三位租客分別租用三個房間,但租約沒有註明那位租客租住那個房間,更甚者,程女士更聲稱對這細節安排從不知情,三位租客簽立的是獨立租約,如程女士完全不知道誰人佔用那房,在任何一位租客欠租時,她如何處理收樓程序?如本案的申請般,只向一人追討收回整個三房單位?作為業主的程女士的作為完全不合情理;

三) 程女士指稱在入稟本案時,向本審裁處職員透露132號內其實有兩個單位,因而被教導在租約上加上「B」字作識認,這實在是匪夷所思,審裁處的職員絕對不可能教導任何入稟人仕,擅自改動提交的租約內容;

四) 而如果程女士懂得向審裁處職員披露132號內其實有兩個單位,為何沒有同時透露該三房單位實際是出租予三位人士及三位也拖欠租金的事實,由此可見,程女士在入稟本案時,是刻意隱瞞這事實;

五) 而程女士又為何沒有在其申請中披露,其實該三房單位的租客已沒再使用,而是由葉氏一家霸佔了,程女士刻意隱瞞了這事實,實在難以令人接受她是誠實可靠的證人;

六) 程女士指稱,葉氏一家在2015年4月,私自由該兩房單位遷進該三房單位,並同時佔用了132號內的兩個單位,唯程女士對此等侵佔行為不聞不問,一直沒有採取任何行動,即使在租客向她投訴未能返回單位亦然,只在禁區開放後才向葉先生要求簽立租約,如程女士真箇已將該三房單位出租予曾女士等三人,但該三房單位卻被葉氏一家佔用了,她怎可能如此處之泰然,程女士的行為,完全與該三房單位已出租的事實不符;

七) 程女士指在曾女士出現欠租的情況下,她曾向曾女士查詢,但曾女士只說不再交租也不再租用,如該三房單位被葉氏一家霸佔了而令租客不能使用,甚至將租客的物品搬走,曾女士又怎會不提出此一情況,可見程女士所言不是事實。

31.  更重要的是,程女士指稱該三房單位已出租予曾女士等三位人仕的證供,與吳警長的證供不符。從吳警長的證供可見,曾女士、曹女士及李先生在涉案租約生效期內,從未獲發出任何居民禁區紙,如曾女士三人租用了該三房單位,又怎會不申請居民禁區紙?程女士曾在證供中解釋,她在與三人簽立租約時,已清晰明言不會替三人申請禁區紙,依據吳警長的證供,這是不可能發生的,因為如以租約申請禁區紙,在首次立約時,業主必須陪同租客作出禁區紙的申請,業主亦須交付寮屋牌,曾女士等三人在與程女士簽立租約以前,已分別曾申請過居民禁區紙,不可能不知道此一規定,在程女士表示不會替他們作出禁區紙申請的情況下,他們明知不可能以涉案租約成功申請禁區紙的情況下,他們租用涉案單位卻不能使用,又怎會簽立租約?本席認為實情應如楊女士所言,曾女士告知她,在為該兩房單位簽立租約後,因未能成功申請禁區紙,故而租約根本未有執行。

32.  申請人一方曾嘗試提出,曾女士等三人可能以持有的非居民禁區紙在禁區內逗留,以使用涉案租約下的該三房單位,但曾女士在2014年11月28日至2015年1月10日期間,只獲發出了兩次探訪紙,之後沒再申請,如申請人的說法成立,即曾女士繼續白付租金至2015年5月,卻除了獲發探訪紙的8天外,未有使用租用單位,這實在難以令人置信。而曹女士及李先生表面上獲發出探訪紙的次數頗高,但其實在2014年11月至2015年12月的時段內,當中只有6個月(2014年11月28日至2015年5月)屬程女士聲稱曾女士三人佔用該三房單位的時段,他們的探訪證日期雖較曾女士為多,但情況也與真箇租用了該三房單位的情況不吻合。

33.  相反地,葉先生一方的證供較為可信,證人互相佐證,也獲水電費單據等文件支持。本席接納他們的證供。裁斷葉先生及其家人一直以來也居住在該三房單位,而並非強行霸佔,故此即使程女士與曾女士確實存在租約關係,涉案租約的單位也不可能是該三房單位。在這情況下,程女士以曾女士欠租為由,獲得法庭針對該三房單位而作出的該收樓令,不可能成立,該收樓令及該收樓令狀也應予以擱置。

葉先生在該三房單位的權益

34.  基於上文就涉案單位並非該三房單位的裁斷,本席認為無須就葉先生在該三房單位的權益(即爭議事項三)作裁斷,這亦是因為考慮到本審裁處對葉先生在該三房單位的權益並無審理權,而且葉先生在本審訊中亦清晰表達,他將會就此一爭議,在其他法院作出申索,在這情況下,本席認為不應就此一爭議事項在本案中處理。

頒令

35.  本席頒令,本審裁處在2016年3月9日頒下的該收樓令,及在2016年4月1日發出的收樓令狀,均予以撤銷。

36.  在訟費應視乎訴訟結果而定的大前題下,本席頒令申請人須付第二及第三答辯人本申請的訟費,包括大律師證書,如雙方未能就訟費數額議定,則由法庭依區域法院基準作評定。這是暫准訟費命令,除非任何一方以傳票申請,否則本暫准訟費命令在本判決書發下後14天成為絕對命令。
