D E C I S I O N

The application

1.  The applicant is an illegal immigrant by staying in Hong Kong without permission and she lodged a non-refoulement claim with the Director of Immigration (“the Director”). The Director rejected her application and she appealed to the Torture Claims Appeal Board (“the Board”). Having considered her evidence, the Board, by its Decision (“the Board’s Decision”), rejected her appeal and affirmed the Director’s Decision.

2.  Pursuant to Order 53, rule 3(2) of the Rules of the High Court (“RHC”), the applicant filed Form No. 86 to apply for leave to apply for judicial review of the Board’s Decision.

3.  By Form CALL-1 dated 19 December 2025 (“the Court’s decision”), the Court dismissed her application for the reason that there is no realistic prospect of success in her intended application.

4.  The Court’s decision was sent to the applicant on 19 December 2025 at her last known address without being returned from the Post Office. She is deemed to receive the Court’s decision[1].

5.  The time for filing the notice of appeal expired on 2 January 2026[2].

6.  By summons filed on 8 January 2026, the applicant applied for appeal against the Court’s decision out of time. She is late for 2 days.

7.  In her affirmation support of her application, the applicant said that she did not receive the Court’s decision.

Discussion

8.  Pursuant to Order 32, rule 11 and 11A and Order 53, rule 3(3) of the RHC, having considered the applicant’s reason, I decide to determine this application on paper without an oral hearing[3].

9.  The Court will consider the factors as set out in AW v. Director of Immigration and William Lam [2016] 2 HKC 393 at para. 27(3) in considering if extension of time should be extended: (1) the length of delay; (2) the reasons for the delay; (3) the prospect of the intended appeal; and (4) the prejudice to the putative respondent if extension of time was granted. I shall consider the merits of her case.

10.  In Re Adumekwe Rowland Ejike[2019] HKCA 702, the Court of Appeal held:

“19. The prospect of success of the intended appeal is important: the court will not grant extension for a hopeless appeal to be pursued, see Re Rahman Wasif[2019] HKCA 299 at [13]; Re Kpamou Gbotoi Bernard[2019] HKCA 168; and Re Irshad Muhammad[2018] HKCA 864 at [16].”

11.  The applicant claimed that if refouled, she will be harmed or killed by her sister, from whom she had borrowed money and was unable to repay.

12.  The Director rejected her claim because it was not substantiated. She appealed to the Board.

13.  Having considered the evidence, the Board dismissed her appeal for the reason that it did not accept her evidence. Further state protection is available and internal relocation is viable.

14.  The reason under paragraph 7 is not valid for his delay.

15.  There is no valid reason from the applicant to challenge the Board’s Decision or this Court’s decision.

16.  In the circumstances, I refuse to extend time for her appeal. Accordingly, I dismiss her application.

Observations for the Applicant:

THE APPLICATION

1.  The applicant applies for leave to apply for judicial review of the Decision dated 20 May 2025 of the Torture Claims Appeal Board (“the Board’s Decision”).

2.  The applicant did not ask for a hearing.

3.  Pursuant to Order 20, rule 8 and Order 53, rule 3(6) of the Rules of the High Court, Form 86 is amended to the effect that the proposed respondent is the Board and the Director of Immigration is the interested party.

The applicant

4.  The applicant is a national of India. She was an illegal immigrant for the reason that she overstayed since 7 June 2011 after termination of her employment contract. She was arrested. She lodged a non-refoulement claim on the basis that, if refouled, she will be harmed or killed by her sister S from whom she had borrowed money, but she was unable to repay her debt. Her sister had threatened to hire someone kill her.

The Director’s Decision

6.  The Director considered the applicant’s claim in relation to the following risks:

a.  risk of torture under Part VIIC of the Immigration Ordinance, Cap. 115, (“the Ordinance”) (“Torture risk”);

b.  risk of violation of the right to life under Article 2 of Section 8 of the Hong Kong Bill of Rights Ordinance, Cap. 383 (“HKBOR”) (“BOR 2 risk”);

c.  risk of torture or cruel, inhuman or degrading treatment or punishment (“CIDTP”) under Article 3 of Section 8 of the HKBOR (“BOR 3 risk”); and

d.  risk of persecution by reference to the non-refoulement principle under Article 33 of the 1951 Convention relating to the Status of Refugees and its 1967 Protocol (“Refugee Convention”) (“Persecution risk”).

7.  By way of the Notice of Decision dated 19 February 2025 (“Director’s Decision”), the Director dismissed the applicant’s claim on all applicable risks because it was unsubstantiated.

The Board’s Decision

8.  The applicant appealed the Director’s Decision to the Board. On 9 May 2025, the Board conducted an oral hearing for her. She had given oral evidence and answered the Board’s questions.

9.  Having considered the evidence, the Board made the findings below.

(1)  There was no evidence to support her allegation that her sister would hire someone to kill her. [45]

(2)  She may be safe to live in some other parts of India. [45]

(3)  Internal relocation in cities such as Delhi, Mumbai, Bengaluru or Punjab would be safe for her. [46]

10.  For the above reasons, the Board dismissed her appeal.

Application for leave to apply for judicial review of the Board’s Decision

11.  The applicant has filed Form 86 dated 23 May 2025 for leave to apply for judicial review of the Board’s Decision.

12.  The applicant has not raised any specific ground to challenge the Board’s Decision.

DISCUSSION

13.  The role of this Court is supervisory, meaning that it ensures that the Board complied with the public law requirements in coming to the Board’s Decision on the applicant’s appeal. The Court will not usurp the fact-finding power vested in the Director and the Board. See TK v Michael C Jenkins Esq and Director of Immigration [2013] 1 HKC 526, §40 and Nupur Mst v Director of Immigration[2018] HKCA 524, §14 (1).

14.  The Court will bear in mind that the Board’s Decision should be examined with rigorous examination and anxious scrutiny.

15.  In Re: Kartini[2019] HKCA 1022, 9 September 2019, the Court of Appeal held:

“13. (1) … …Assessment of evidence and COI materials and risk of harm, state protection and viability of internal relocation are primarily within the province of the Board (and the Director). The court will not intervene by way of judicial review unless there are errors of law or procedural unfairness or irrationality in the decision of the Board.”

16.  From the Board’s findings, it appears that the Board did not dispute the facts that the applicant has raised. However, those facts do not support her non-refoulement claim under the relevant statutory provisions. It is on this basis that the Board dismissed her appeal.

17.  The applicant has raised no valid ground to challenge the Board’s Decision.

18.  The applicant fails to show that she has any realistic prospect of success in her proposed judicial review of the Board’s Decision.

DISPOSITION

19.  I refuse to grant leave to the applicant to apply for judicial review of the Board’s Decision. Accordingly, I dismiss her application.
